Estate Planning

Planning for the future before it's too late

Clients often place Victorian estate planning at the bottom of their priority list until it’s often too late.

Effective estate planning encompasses more than just a single document. It typically includes various powers of attorney, arrangements for medical decision-making, and superannuation nominations. One of the most critical documents in any Victorian estate plan is the enduring power of attorney. This allows you to designate a trusted individual as your financial decision maker to manage your affairs if you lose capacity or need assistance. In Victoria, these documents are regulated by the Powers of Attorney Act 2014 (Vic) and are essential for safeguarding your financial and personal interests, along with complying with the Medical Treatment Planning and Decisions Act 2016 (Vic) for medical decision-making documents.

There are two primary types of powers of attorney in Victoria:

1. Enduring Power of Attorney (Financial and Personal)— which enables your appointed attorney to handle financial matters, personal decisions, or both.

2. Appointment of Medical Treatment Decision Maker** — allowing someone to make medical decisions on your behalf if you become unable to do so.

These documents must be prepared with meticulous attention to detail. Inaccurate wording, vague instructions, or selecting an unsuitable person can lead to disputes, financial risks, or decisions that do not align with your wishes. For families, having valid powers of attorney in place can eliminate the need for VCAT guardianship or administration orders — a process that can be both stressful and time-consuming.

At Corner Legal, we create powers of attorney with clarity and care, focusing on protecting your future. We explain your options in straightforward language, assist you in selecting the right decision-makers, and ensure your documents meet Victorian law requirements. Whether you’re planning for the future, updating old documents, or addressing concerns about a loved one’s capacity, we offer practical guidance and reliable support.

If necessary, our team can also provide comprehensive advice on VCAT guardianship and administration orders and assist you if required.
